TRANSPORTATION TERMS The transportation of passengers, vehicles and luggage effect according to the regulations of the Athens conventions from 1974 of passenger transportation at sea and the general transportation conditions of RECA Marmara Nakliyat Denizcilik Isletmeleri Sir. A.S. These conditions are limiting the liability of the Shipping Company in case of death, injuries of persons and/or damages or losses of vehicles or luggage as well delays or changes of the route. BOOKINGS Bookings can be made at the General Sales Agent RECA and most travel agents. A booking is for the passenger a binding offer for a contract. With the confirmation and invoice a firm contract is signed. Until this time all our and in name of us given declarations are subject to alteration. In case of a difference from the enrolment to our confirmation, the passenger has to contradict within 10 days after receipt of our confirmation and invoice otherwise the booking is binding according to our confirmation. The passenger accepts with his booking the booking and transportation terms for himself and all other persons for whom he is booking. Pregnant women are not allowed to travel on the ferry without a medical certificate. FARES After receipt of the confirmation and invoice 10% of the fare have to be paid as down payment. The remaining amount has to be paid latest 30 days before departure time. Travel documents will be sent immediately after receipt of the payment by us through RECA or the booking travel agent. In case of delayed payment we can withdraw the booking and claim cancellation fees. COMPANY SERVICES AND PRICES All services are according to the description in our brochure and our written confirmation. We reserve the right to withdraw the contract, change the schedules, change, cancel or interrupt sailings due to unforeseen and unusual circumstances (bad weather and sea conditions, stoppage at docks, strike etc.) and any other kind of Acts of God. We will make every possible effort to adhere to the timetables inscribed in the brochure. We reserve the right to readjust fares without notice due to Acts of God, monetary fluctuations or fuel increases. In case of an increase of more than 5 % of the total fare the passengers has the right to cancel his voyage without any cancellation fee. EMBARKATION - CHECK IN All passengers have to be at the check-in counter of RECA Marmara at last minimum 3 hours before departure. All passengers must posses the necessary travel documents. In case of non-compliance with the embarkation time of 3 hours before departure the passenger will loose the right for transportation. CANCELLATIONS The passengers can cancel the voyage only in writing. According to the time when the writing cancellation is made know to us following cancellations fees will be applied on the total fare: - Until 30 days before departure 10 % - Until 15 days before departure 15 % - Until 7 days before departure 25 % - Until 1 days before departure 50 %. Within 24 hours prior to the actual time of departure or later no refund is made and the ticket is considered as void. A refund can only be made by the issuing agent. Port agents can only invalidate tickets but not refund them. REBOOKING After confirmed booking for every rebooking a fee of Euro 25,- applied. In case of different cabin categories and seasons the difference to a lower new price will not be refunded. Rebooking is only minimum 2 working days before the booked departure time possible. In case of the cancellation of a rebooked voyage the voyage with the shorter cancellation date is always considered. OPEN DATE TICKETS AND LOSS OF TICKETS Holders of open date tickets must confirm their departure date well in advance to us or a authorised agent. We bear no responsibility if there is no accommodation or the booked accommodation category available. Cancellation of an open date ticket and a refund can be obtained only from the issuing Agency and against a fee of Euro 25,-. Open date tickets are only valid for the year in which they are purchased. In event a passenger has lost his/her ticket, he/she must immediately notify the issuing travel agent or us. The refund of a lost ticket is only at the end of the seasons possible if no refund for this ticket has been made. LIABILITY The liability of RECA MARMARA Nakliyat Denizcilik Isletmeleri Sir..A.S. is limited to the triple of the fare in case that a damage has not be caused intentional or gross negligent by ourselves or by an accomplice of ours. There is no liability guaranteed for vehicles with tail spoiler, other special constructions or setting lower. The shipping of this kind of vehicle will only happen on the clients own responsibility. PROPORTIONS OF VEHICLES The measures of length and height mentioned in the prices for vehicles are including all additions to the vehicles. This means, whenever a vehicle with a porter is higher than 1,70 m, it will automatically fit into the next category. REDUCTIONS Reductions are granted according the brochure. After a ticket is issued a reduction can only be given against a fee of Euro 25,-. Various reductions can not be combined with each other. CLAIMS AND LAPSE All claims regarding services on board not granted as stipulated in the voyage confirmation have to be made immediately on board , but latest within 6 weeks after the voyages has been finished in writing to us. All claims will lapse 6 month after the voyage is finished. TICKET DEPOSIT AND FAX CONFIRMATION Deposit of tickets at the port agent or confirmation of the voyage can be made against a extra fee of Euro 25,-. They can be fetched up by the passengers with a valid identification. GENERAL All Information have been given under the reservation for changes and without any guarantee. The fact of that one or the other of the terms is not operative does not influence the validity of the terms in general.
